CANADIAN IMMIGRATION. A CLEAR APPROACH TO COMPLEX CASES
Immigration file records can help clarify how an application was assessed and what concerns were recorded.
Lex Nova assists with requesting relevant records and examining them alongside the application, supporting documents and correspondence from immigration authorities.
A detailed review may be appropriate where:
Access to Information and Privacy (ATIP) requests provide a process for seeking records held by federal institutions. Depending on the matter, relevant records may include notes from the Global Case Management System (GCMS), application documents and correspondence available for disclosure.
Lex Nova identifies the records relevant to the issue, assesses the appropriate request procedure and prepares the request with the required consent and supporting information.
Before requesting additional records, Lex Nova reviews any officer decision notes already provided with the refusal and considers whether further disclosure would assist the assessment.
The analysis considers the records alongside the refusal letter, application forms, supporting evidence and previous submissions. Particular attention is given to recorded concerns, discrepancies, missing evidence and the reasoning underlying the decision.
The review distinguishes between information provided by the applicant, processing entries and an officer’s assessment. Records may help clarify the case, but they do not necessarily provide a complete account of every consideration or establish that an error occurred.
The findings may inform a revised application, a request for reconsideration or a response to immigration correspondence. Lex Nova identifies which concerns require additional evidence, which statements need clarification and whether the records suggest issues requiring separate professional advice.
Requesting records does not reopen an application, reverse a refusal or guarantee faster processing. An ATIP request should not be treated as a substitute for responding to correspondence or taking timely advice about an available remedy.
Depending on the agreed scope, services may include:
Disclosure is subject to applicable access rules. Some information may be withheld or redacted, and response times may vary. Lex Nova does not guarantee full disclosure or receipt by a particular date.
Services concern record requests and immigration file analysis within the authorized scope of an RCIC practice. Court proceedings are outside this service.
For an initial assessment, provide a brief application history, the relevant decision or correspondence, any officer notes already received and details of approaching deadlines. Sensitive documents should be provided through the method specified by Lex Nova.
